This privacy notice (“Notice”) describes how Jovance Professional Studios Inc., doing business as, Joule Fitness Studio ("Joule," "we," "us," "our") collects, uses, shares, and retains when you (1) access joulefitnessstudio.com, or any other website that we offer that directly links to this privacy policy (each a "Site" or collectively the "Sites"), (2) when you use our products and services, including the Joule Fitness Studio online platform, any Studios calendar, video, and workout tracking widgets, (3) when you interact with us or otherwise communicate with us in any manner, including by email, telephone, and/or in person ("Communication(s)"), and (4) when we interact with certain third parties. 


We encourage you to read this Notice in full to understand our privacy practices before using our services.


WHAT TYPE OF INFORMATION WE COLLECT


Depending on how you interact with our Sites and Services, the nature of our Communications, and how we may interact with certain third parties, we collect the following information:


Basic Identifying Information. 

Information you provide when you sign-up for an account for our Services such as your first name, last name, postal address, e-mail address, password, phone number, and other similar identifiers. Device Identifier and other Unique Identifiers. Information such as your device identifier, internet protocol (IP) address, cookies, beacons, pixel tags, mobile ad identifier, and other unique identifiers. Internet or Other Network Activity. Information such as your browsing or search history, landing pages, referring pages, exit pages, domain names, and URLs and other information regarding your interactions with our Sites, emails, and advertisements.


Geolocation Data. 

Information that permits us to determine your location.  


Payment Information. 

Information such as your credit card number, billing address, and other related payment information provided in connection with payments.  


Commercial Information. 

Information such as the products and samples you have purchased and considered, your preferences, and related information about your commercial activities.


Demographic Information. 

Information such as your age, gender and date of birth.


User Content. 

Information such as your Communications with us, content within any messages you publicly post on the Services, and any other content you provide, such as social media profiles, images, videos, survey responses, comments, product reviews, testimonials, and other content.


Physical and Exercise Information. 

Information such as your physical limitations (i.e., pregnancy, postnatal, joint pain, low-back problems), exercises, target exercise results and


Audio and Visual Information. 

Information such as photographs, images, videos, and recordings of your voice (such as when we record customer service calls for quality assurance).


Inferences. 

Information such as inferences drawn from or created based on the information identified above.


HOW DO WE COLLECT YOUR INFORMATION


We collect your information in three ways: (1) directly from you when you use our Sites, Services, and Communicate with us; (2) automatically using online technologies when you engage with our Sites, Services, and Communications; and (3) from our third party partners.


Directly from you. 

We collect information directly from you when you enter your information on our Sites, create an account for our Services, update your profile, update your information in connection with certain features of our Services, access our content, participate in our loyalty or reward programs, take a survey or a poll or enter a contest, engage in Communications with us, or sign-up to receive emails, text messages, or certain other Communications from us. You can control what information is provided to us for the Services. Certain information like an email address and name are required to use the Services. Other information may be optional in order to use certain features provided through the Services. Such optional disclosures include information such as your birth date, User Content and Physical and Exercise Information (as listed above).


Automatically Using Online Technologies. 

When you visit our Sites, interact with our Services, open or click on emails we send you or related Communications, or interact with our advertisements, we or other third parties may automatically collect certain information about you using online tracking technologies such as cookies, pixels, web beacons, software developer kits, and related technologies. From Third Parties. 

We collect information from third parties as follows:


Other Users. 

Other users may share information about you when they use our Services. For example, your partner may add you to their profile information or share your email address to add you to the partner account. In the event you submit other information about yourself, the availability of that information to other users will be controlled by privacy settings you will set for your account.


Third-party Service Providers. 

Joule Fitness Studio receives information about you from third-party service providers who act on our behalf. These services include fulfilling orders or purchases, payment processing, validating contact data, providing analytics, security services, sending marketing communications, and providing cloud infrastructure.


Partners. 

We receive information about you from our partners who provide a variety of services to Joule Fitness Studio. These services may include consulting, training, analytics, marketing, and advertising. 


HOW WE USE YOUR INFORMATION


We use your information for a variety of purposes, including to:


Provide our Sites and Services to You. 

We use your information to provide our Sites and Services to you, including to: (1) create and manage your account when you sign-up to use our Services; (2) authenticate your account; (3) facilitate your access and use of our Sites and Services; (4) process your orders and payments related to your subscription and purchases; (5) provide you our newsletter or surveys; (6) improve the Sites and Services; (7) personalize or tailor the experience of our Sites and Services for you, as well as the content we present or offer to you; (8) send you notifications relating to your account and participation in our Services; (9) make recommendations to you; (8) answer your Communications; (10) diagnose technical problems and to provide technical support, and (11) perform other related business functions, including audits, develop new products and services and protect our Services, Sites, customers, or other third parties. We may also combine the information you provide with information we collect from other Joule Fitness Studio services and/or third parties in order to provide you with a better experience and to improve the quality of our Services.


Communicate with You. 

We use your information to engage in Communications with you, such as to respond to your requests, inquiries, issues, feedback, and to provide customer service.


Market and Advertise. 

We use your information for marketing and advertising purposes, including sending marketing, advertising, and promotional communications to you by email, text message, or postal mail, as well as marketing research. We also use your information to show you advertisements for Services, on our Sites and other websites and third-party services such as social media services, and to administer our sweepstakes and other contests.


Conduct Analytics and Personalization. 

We use your information to conduct research and analytics, including to improve our Sites and Services. We also use your information to understand your interaction with our Sites, advertisements, Services, and our Communications with you. We also use your information to personalize your experience, to save you time when you visit our Sites and use our Services, to better understand your needs, and to provide personalized recommendations for our Services.

Security and Fraud Prevention. We use your information to detect, investigate, prevent, or take action regarding possible malicious, deceptive, fraudulent, or illegal activity, including fraudulent transactions. We also use your information to enforce our terms and procedures, prevent against security incidents, and prevent the harm to other users of our Services.

We use your information to comply with our legal and regulatory obligations, to establish and exercise our rights, and to defend against legal claims.


Business Functions. 

We use your information to support our core business functions, including to maintain records related to business management, loss prevention, collecting amounts owed, and identifying and repairing errors or problems in the Sites.

Cookies and Tracking Technologies


When you visit Joule Fitness Studio, we send one or more cookies – a small file containing a string of characters – pixels, web beacons, software development kits, and other similar online tracking technologies to your computer that uniquely identifies your browser. We use these technologies to improve the quality of our Services by storing user preferences and tracking user trends, track user movements on the Sites, as well as to maintain security of our Services, manage your accounts, prevent crashes, provide advertising and analytics, and other performance functions. Surveys and Contests


We use our surveys and contests to collect your feedback to improve your experience and our Services. We may use a third-party service provider to conduct surveys and contests on our behalf. We do not share the results of surveys or survey information with third parties and your participation in our surveys or contests is voluntary. However, we may share aggregated results of surveys with third parties.


You have a choice whether or not to disclose this information. Your choices will be described in the survey or contest message. Please refer to each survey or contest rules for more information. If you outline any issues and/or request our help in our surveys and contests, we may reach out to you to resolve your concern.


Product Giveaway and Other Promotions


If you opt into product giveaways, sweepstakes, or other promotions, we will use personal information to allow you to participate in these activities. Some of these activities have additional rules and privacy terms attached to them. We do not share personal information related to our giveaways, sweepstakes, or other promotions with third parties, unless otherwise noted in the Terms and Release of Waiver. Advertising and Analytics


We use analytics services, such as Google Analytics, to help us understand how users access and use the Service. In addition, we work with agencies, advertisers, ad networks, and other technology services to place ads about our products and services on other websites and services. For example, we place ads through Meta (formerly Facebook) that you may view on its platforms as well as on other websites and services.


As part of this process, we may incorporate tracking technologies into our own Services (including our website and emails) as well as into our ads displayed on other websites and services. Some of these tracking technologies may track your activities across time and services for purposes of associating the different devices you use, and delivering relevant ads and/or other content to you (“Interest-based Advertising”). In certain contexts third parties like Meta that provide Interest-based Advertising may independently decide how to process your information. We encourage you to familiarize yourself with and consult their privacy policies and terms of use.


Social Media Features And Widgets


We use social media features, including Facebook, X (formerly known as Twitter), Instagram, and email service provider widgets, such as the share button or similar interactive mini-programs that run on our Services. These features may collect your IP address and other personal data including which page you are visiting on our site and may set a cookie to enable the feature to function properly. Social media features and widgets are either hosted by a third party or hosted directly on our Site. Your interactions with these Features are governed by the privacy notice of the company providing it. Refer to the below section covering online targeting to learn how you can limit such collection. 


If you provide us your personal information, we may use it to interact with you on these social networks. Our interactions with you would also be subject to that social media network's privacy notice, terms of use, and your consent as appropriate.


HOW WE SHARE YOUR INFORMATION


We may disclose or share your information with affiliated and non-affiliated third-parties, including in the following scenarios:


Other Joule Fitness Studio Online Platform Users. We make your profile available to other users according to the privacy settings you set for yourself as part of your profile. Your user name will be identified to us and to any recipient of messages you send through the Service.


Third-party Service Providers. 

Joule Fitness Studio uses third-party service providers who act on our behalf. These third parties are authorized to use personal information about you to provide these services to us. These services may include, but are limited to, fulfilling orders or purchases, payment processing, validating contact data, sending marketing communications, providing analytics, advertising and marketing, social media services, providing cloud infrastructure, and other service providers who provide us a service (e.g., customer service, auditing, marketing, debugging to identify and repair errors that impair existing intended functionality on our Sites, and/or protecting against malicious, deceptive, fraudulent, or illegal activity).


Partners. 

From time to time, we work with other third parties who act as our partners to offer you joint products and services. If you decide to use such products or services, we will share certain information about you with our partners in accordance with this Privacy Notice, our Terms and Conditions, and any applicable provisions of our partner agreements. We may share your information with partners in connection with their services, such as to assist with billing and collections, provide localized support, and deliver customizations.


Business Transfer Events. 

If Joule Fitness Studio becomes involved in a merger, acquisition, joint venture, corporate reorganization, financing, any form of sale of some or all of its assets, or in the unlikely event of insolvency, bankruptcy, or receivership, we may transfer information about you in connection with such event.


Public authorities. 

In certain situations, we may be required to disclose information about you in response to lawful requests by public authorities, including national security and local law enforcement. We may share non-personally identifiable information (such as anonymous usage data, referring/exit pages and URLs, platform types, number of clicks, items on your registry, etc.) in any manner, including with interested third parties to help us improve our Services, help them understand the usage patterns for our Services, develop new products and services, and for marketing and analytics purposes. 


CHOICES YOU MAY HAVE


Account. You may access, update, or remove certain information that you have provided to us through your account by visiting your account settings or sending an email to the email address in the Contact Us section below. We may require additional information from you to allow us to confirm your identity.


Please note that we will retain and use information about you as necessary to comply with our legal obligations, resolve disputes, and enforce our agreements.


Communications. The following is information about how to opt out of receiving certain communications from, depending on means of delivery:


Marketing communication.

Email. You can choose to unsubscribe from our marketing emails at any time by clicking on the unsubscribe link at the bottom of any email message.


SMS. You can choose to opt out of SMS messages at any time by replying to a message you receive with the word “STOP”. 

If you have created a Joule Fitness Studio account, you may access, manage, and update your account information and communication preferences using your account or by contacting us directly at team@joulefitnessstudio.com.


Transactional communication. From time to time, we may send you transactional email with announcements, payment confirmations, changes to our services, and other similar administrative messages. You do not have the opportunity to opt out of receiving these messages.

Third-Party marketing, advertising, and other communication. You may opt-in to receive emails or other communications from our partners, vendors, or affiliates. If you do opt-in, you may be subject to the third-party’s separate Privacy Notice. You are responsible for managing your email preferences subject to that statement. Please note that some advertising companies may gather information about your visit to the Services through cookies, web beacons, and other technologies in order to enable advertising companies to market products or services to you, to monitor which ads have been served to your browser, and which webpages you were viewing when such ads were delivered. Push Notifications. If you have opted-in to receive push notification on your device, you can opt-out at any time by adjusting the permissions in your device or uninstalling our mobile application.

Cookies and Tracking Technologies


The following disclosures relate to your rights and choices in connection with cookies and other tracking technologies:


Cookies. Most browsers accept cookies by default. You can instruct your browser, by changing its settings, to decline or delete cookies. If you use multiple browsers on your device, you will need to instruct each browser separately. Your ability to limit cookies is subject to your browser settings and limitations.

Mobile Application and Location Technologies. You can stop all collection of information via our mobile application by uninstalling the mobile application. You can also reset your device Ad Id at any time through your device settings, which is designed to allow you to limit the use of information collected about you. You can stop all collection of precise location data through the mobile application by uninstalling the application or withdrawing your consent through your device settings.


Analytics and Advertising. Google provides tools to allow you to opt out of the use of certain information collected by Google Analytics at https://tools.google.com/dlpage/gaoptout and by Google Analytics for Display Advertising or the Google Display Network at https://www.google.com/settings/ads/onweb/. You may also limit our use of information collected from or about your mobile device for purposes of serving targeted ads to you by going to your device settings and selecting “Limit Ad Tracking” (for iOS devices) or “Opt out of Interest-Based Ads” (for Android devices).


Please be aware that if you disable or remove tracking technologies some parts of the Services may not function correctly. Potential Rights Under Data Privacy Laws When Applicable


Depending on where you reside, you may have certain legal rights with respect to your information. If you believe you are entitled to certain rights under applicable law, we will comply as required, including with respect to the following rights:


A right of access to information undergoing processing. Joule Fitness Studio may charge a reasonable administrative fee if further copies of your information are requested. A right to rectify inaccuracies in information Joule Fitness Studio collects and holds about you. If your account information is incomplete or inaccurate you can update your information directly in your Joule Fitness Studio account or contact team@joulefitnessstudio.com for assistance.


A right to require your information to be provided to you or to another company in a commonly used electronic form.


A right to object to specific types of processing such as direct marketing, processing based on legitimate interest or performance of a task in the public interest/exercise of official authority, and processing for research or statistical purposes.


A right to have your information ‘erased’ or to restrict processing of information.


A right to withdraw your consent for future processing.


HOW WE PROTECT YOUR INFORMATION


We use reasonable and appropriate physical, technical, and administrative industry safeguards to protect information from unauthorized access, use, disclosure, destruction, loss, misuse or unauthorized alteration. We will make reasonable efforts to protect personal information stored on our servers from unauthorized access using commercially available computer security products (for example, firewalls), as well as carefully developed security procedures and practices.


INTERNATIONAL TRANSFERS


Joule Fitness Studio, its Services, and users are based in the United States (the “US”), Canada, and the Philippines. When you use our Services, we may transfer, store, and process information about you to servers and databases located outside of your home country. The privacy and data protection laws in the US may not be equivalent to such laws in your country of residence.


CALIFORNIA RESIDENT SHINE THE LIGHT STATEMENT


Users who are California residents may request and obtain from us once a year, free of charge, certain information about the personal information (if any) we disclosed to third parties for direct marketing purposes in the preceding calendar year. If applicable, this information would include a list of the categories of personal information that was shared and the names and addresses of all third parties with which we shared information in the immediately preceding calendar year. If you are a California resident and would like to make such a request, please submit your request in writing to team@joulefitnessstudio.com.


CHILDREN'S PRIVACY


Joule Fitness Studio does not knowingly target children under 13 and makes reasonable efforts to ensure that the targeting of children under 13 does not occur. Children 13 and under are not eligible to use our Services without the participation and supervision of a legal parent or guardian. If we become aware of having collected personally identifiable information from a user who is younger than 13 years of age without prior, verifiable consent from a parent or legal guardian, we will remove such information from our files. If you believe your child has provided Jould Fitness Studio with personal information, please contact us so we can remove the information. We urge parents to monitor their children's use of all digital media.


We recommend that minors between the ages of 13 and 17 ask their parents for permission before sending any information about themselves to anyone over the Internet.


DATA STORAGE AND RETENTION


We store your information as long as necessary to provide our Services and to fulfill our business, legal, and contractual obligations. If your account has no activity for 50 months, Joule Fitness Studio may delete your account information.


LINKS TO OTHER WEB SITES


In an attempt to provide increased value to our visitors, Joule Fitness Studio may choose various third party web sites to link to, link from, and frame within the Site. Joule Fitness Studio also may participate in co-branding and other relationships to offer e-commerce and other services and features to its users. However, even if the third party is affiliated with Joule Fitness Studio, we have no control over these linked sites, each of whom have separate privacy and data collection practices independent of Joule Fitness Studio. Please remember that we cannot control the information that is shared by members and that anything you voluntarily provide in any public area of the Internet will be publicly available to other visitors on that web site and potentially to other third parties. UPDATES TO OUR PRIVACY NOTICE
